NOTICE OF PUBLIC HEARING

AND

BUSINESS IMPACT ESTIMATE

 

NOTICE OF PROPOSED ENACTMENT OF AN ORDINANCE ANNEXING CERTAIN PROPERTY TO THE CITY OF PLANT CITY AND REDEFINING THE BOUNDARIES OF THE CITY OF PLANT CITY TO INCLUDE SAID PROPERTY.

               In accordance with Section 166.041 and 171.044, Florida Statutes, and other applicable law, the City Commission of the City of Plant City, Florida, does hereby give notice of the proposed enactment of an ordinance entitled:

ORDINANCE NO. 47-2023

 

AN ORDINANCE ANNEXING TO THE CITY OF PLANT CITY, FLORIDA, CERTAIN REAL PROPERTY UPON PETITION OF THE OWNERS THEREOF, AND REDEFINING THE BOUNDARY LINES OF SAID MUNICIPALITY SO AS TO INCLUDE THEREIN SAID REAL PROPERTY, AS PROVIDED IN SECTION 171.044, FLORIDA STATUTES.

              The proposed enactment of said ordinance, following second reading, shall be considered by the City Commission at its meeting in the City Commission Chambers of the Nettie Berry Draughon Municipal Building, 302 West Reynolds Street (City Hall), Plant City, Florida, on January 22, 2024, at 7:30 p.m., or as soon thereafter as the matter may be heard, at which time interested parties and citizens may appear and be heard with respect to the proposed ordinance.

               All persons are advised that if a person decides to appeal any decision made by the City Commission with respect to any matter considered at such meeting, he or she will need a record of the proceedings, and for such purpose he or she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.

               In accordance with the Americans with Disabilities Act, any person with a disability requiring reasonable accommodation in order to participate in this meeting should call the City Clerk at (813) 659-4200 at least 48 hours prior to the public hearing.

               The proposed ordinance, which includes the complete legal description by metes and bounds of the area proposed to be annexed, may be inspected by the public at the office of the City Clerk at the Nettie Berry Draughon Municipal Building, 302 West Reynolds Street, Plant City, Florida.

               Brief general descriptions of the areas proposed to be annexed are as follows:

ANX-2023-01 Tindle - Baptist Church Road

39.16 acres lying in Section 5, Township 29 South, Range 22 East, Hillsborough County, lying North of Charlie Griffin Road, East of Baptist Church Road, South of W. Alexander Street, with folio numbers 091234-0000, 091243-0100, and portions of folios 091243-0050 and 091259-0000.

ANX-2023-02 Sudler-Wilson – Charlie Taylor Road and US Hwy 92 E

7.18 acres lying in Section 25, Township 28 South, Range 22 East, Hillsborough County, lying North of U.S. Highway #92 (State Road #600), East of Charlie Taylor Road, with folio numbers 090515-0000, 090516-0000 and 090517-0000.

ANX-2023-03 McDonald – Trapnell Road

16.77 acres lying in Section 9, Township 29 South, Range 22 East, Hillsborough County, lying North of East Trapnell Road, West of Silver Maple Drive with folio numbers 091751-0000 and 091752-0000.

ANX-2022-11 – BSD, Southern Oaks LLC – Cypress Business Park, LLC – Swindell &County Line Roads

AN ORDINANCE OF THE CITY OF PLANT CITY, FLORIDA REGARDING THE BOUNDARIES OF THE CITY; ANNEXING CERTAIN REAL PROPERTY UPON PETITIONS OF HE OWNERS THEREOF, AND REDEFINING THE BOUNDARY LINES OF THE CITY OF PLANT CITY IN SECTION 3-1, PLANT CITY CODE, IN ACCORDANCE WITH CHAPTER 171, FLORIDA STATUTES; PROVIDING FOR SEVERABILILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

This Business Impact Estimate is provided in accordance with section 166.041(4), Florida Statutes.  If one or more boxes are checked below, this means the City of Plant City (the "City") is of the view that a business impact estimate is not required by state law1 for the proposed ordinance, but the City is, nevertheless providing this Business Impact Estimate as a courtesy and to avoid any procedural issues that could impact the enactment of the proposed ordinance.  This Business Impact Estimate may be revised following its initial posting.

☐       The proposed ordinance is required for compliance with Federal or State law or regulation;

☐       The proposed ordinance relates to the issuance or refinancing of debt;

☐       The proposed ordinance relates to the adoption of budgets or budget amendments, including
          revenue sources necessary to fund the budget;

☐       The proposed ordinance is required to implement a contract or an agreement, including, but
          not limited to, any Federal, State, local, or private grant, or other financial assistance
          accepted by the municipal government.

☐       The proposed ordinance is an emergency ordinance;

☐       The ordinance relates to procurement; or

☒       The proposed ordinance is enacted to implement the following:

  a. Part II of Chapter 163, Florida Statutes, relating to growth policy, county and municipal
         planning, and land development regulation, including zoning, development orders,
         development agreements and development permits;

  b. Sections 190.005 and 190.046, Florida Statutes, regarding community development
         districts;

  c. Section 553.73, Florida Statutes, relating to the Florida Building Code; or

  d.   Section 633.202, Florida Statutes, relating to the Florida Fire Prevention Code

In accordance with the provisions of controlling law, even notwithstanding the fact that, an exemption noted above may apply, the City hereby publishes the following information:

1. Summary of the proposed ordinance:

Ordinance 47-2023 would annex 15 parcels into the Plant City corporate limits. Serves public purpose to incorporate into the City which eventually regulates the allowable use of the property.

2. An estimate of the direct economic impact of the proposed ordinance on private, for-profit
     businesses in the City, if any:

(a) An estimate of direct compliance costs that businesses may reasonably incur;

(b) Any new charge or fee imposed by the proposed ordinance, or for which businesses will be financially responsible; and

(c) An estimate of the City’s regulatory costs, including estimated revenues from any new charges or fees to cover such costs.

The proposed ordinance is to amend the city limits boundary. There are currently no businesses located on the property.
The adoption of Ordinance 47-2023 does not impose any direct compliance costs on any businesses, nor does the Ordinance impose any new charge or fee for which businesses will be financially responsible. The ordinance imposes no regulatory costs.

3. Good faith estimate of the number of businesses likely to be impacted by the proposed
     ordinance:

None. There are currently no businesses located on the property.
