NOTICE OF PUBLIC HEARING
AND
BUSINESS IMPACT ESTIMATE
The City of Plant City, Florida proposes to adopt the following ordinance:
AN ORDINANCE OF THE CITY OF PLANT CITY, FLORIDA, REGARDING PARKING STANDARDS; AMENDING SECTION 102-1412, PLANT CITY CODE, REGARDING DOWNTOWN AND MIDTOWN; AMENDING SECTION 102-1413, PLANT CITY CODE, REGARDING STANDARDS FOR OFF-STREET PARKING AREAS; AMENDING SECTION 102-1417, PLANT CITY CODE, REGARDING LANDSCAPING REQUIRED FOR PARKING AREAS; AMENDING SECTION 102-1421, PLANT CITY CODE, REGARDING MINIMUM OFF-STREET PARKING SPACE REQUIREMENTS; PROVIDING FOR PENALTIES; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE.
The City Commission will hold a public hearing on the proposed ordinance in the City Commission Chambers of the Nettie Berry Draughon Municipal Building, 302 West Reynolds Street (City Hall), Plant City, Florida, on August 26, 2024 at 7:30 p.m., or as soon thereafter as the matter may be heard, at which time interested parties and members of the public may appear to be heard with respect to the proposed ordinance. At the conclusion of the public hearing, the ordinance will be considered for approval by the City Commission.
If anyone is planning on presenting a PowerPoint (or other similar) presentation to the City Commission, the person is responsible for coordinating with the City Clerk in advance. At least 48 hours is recommended. Under no circumstances shall the City allow a presentation from any media source (including flash drive and disc) to be presented from a City computer without the City staff having a reasonable opportunity to virus check the presentation.
At the public hearing, all speakers shall be limited to three (3) minutes, unless the speaker requests the City Clerk for additional time no less than forty-eight (48) hours prior to said public hearing. In the event speaker(s) request additional time the determination of the amount of time to be allowed shall be at the discretion of the Mayor, but no speaker shall generally be allowed more than fifteen (15) minutes.
All persons are advised that if a person decides to appeal any decision made by the City Commission with respect to any matter considered at such meeting or hearing, he or she will need a record of the proceedings, and that, for such purpose, he or she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.
In accordance with the Americans with Disabilities Act, any person with a disability requiring reasonable accommodation in order to participate in this meeting should call the City Clerk at (813) 659-4200 at least 48 hours prior to the public hearing.
The proposed ordinance may be inspected by the public at the offices of the City Clerk at the Nettie Berry Draughon Municipal Building, 302 West Reynolds Street, Plant City, Florida.

This Business Impact Estimate is provided in accordance with section 166.041(4), Florida Statutes. If one or more boxes are checked below, this means the City of Plant City (the "City") is of the view that a business impact estimate is not required by state law1 for the proposed ordinance, but the City is, nevertheless providing this Business Impact Estimate as a courtesy and to avoid any procedural issues that could impact the enactment of the proposed ordinance. This Business Impact Estimate may be revised following its initial posting.

districts;c. Section 553.73, Florida Statutes, relating to the Florida Building Code; or
d. Section 633.202, Florida Statutes, relating to the Florida Fire Prevention Code.
In accordance with the provisions of controlling law, even notwithstanding the fact that, an exemption noted above may apply, the City hereby publishes the following information:
1. Summary of the proposed ordinance:
Ordinance 31-2024 would amend the Zoning Code to require an applicant to provide parking at a reduced rate for projects in the downtown core and midtown districts, exempt and reduce requirements for schools to meet parking regulations and provide clarification on requirements for new projects. Serves public purpose to amend the code which regulates the requirements for access and off-street parking.
2. An estimate of the direct economic impact of the proposed ordinance on private, for-profit
businesses in the City, if any:
(a) An estimate of direct compliance costs that businesses may reasonably incur;
(b) Any new charge or fee imposed by the proposed ordinance, or for which businesses will be financially responsible; and
(c) An estimate of the City’s regulatory costs, including estimated revenues from any new charges or fees to cover such costs.
(a) New projects or redevelopment of existing would potentially have to provide parking in areas that it was not required before and may be required to upgrade roadways and install sidewalks in areas where they are substandard or do not exist.
The adoption of Ordinance 31-2024 may impose direct compliance costs on new businesses or redevelopment of existing businesses but would not pose an impact on existing businesses.
(b) The Ordinance does not impose any new charge or fee for which businesses will be financially responsible.
(c) The ordinance imposes no regulatory costs, except for those costs associated with construction if upgrades or new pedestrian facilities are required.
3. Good faith estimate of the number of businesses likely to be impacted by the proposed ordinance:
Unknown. The proposed change requiring certain pedestrian, roadway and parking facilities, may not affect all property owners.
