NOTICE OF PUBLIC HEARING

AND

BUSINESS IMPACT ESTIMATE

 

The City of Plant City, Florida proposes to adopt the following ordinance:

AN ORDINANCE OF THE CITY OF PLANT CITY, FLORIDA REZONING PROPERTY LOCATED ON THE EAST SIDE OF JAMES L. REDMAN PARKWAY (SR 39), NORTH OF TRAPNELL ROAD FROM OAKMONT LANDING PLANNED DEVELOPMENT DISTRICT TO PD PLANNED DEVELOPMENT DISTRICT, IN ACCORDANCE WITH THE PLANNED DEVELOPMENT SITE PLAN OF URBON AT PLANT CITY PLANNED DEVELOPMENT DISTRICT, AS FILED IN THE OFFICE OF THE CITY CLERK; AND APPROVING SPECIFIC APPROVALS.

The City Commission will hold a public hearing on the proposed ordinance in the City Commission Chambers of the Nettie Berry Draughon Municipal Building, 302 West Reynolds Street (City Hall), Plant City, Florida, on January 13, 2025 at 7:30 p.m., or as soon thereafter as the matter may be heard, at which time interested parties and members of the public may appear to be heard with respect to the proposed ordinance.  At the conclusion of the public hearing, the ordinance will be considered for approval by the City Commission.

At the public hearing, the applicant (including their agents and representatives), the City (including staff and consultants) and any other governmental agency (including staff and consultants) shall each be allowed five (5) minutes. The Mayor shall determine the time allowed for all Party-Intervenors (including their agents and representatives). All other speakers shall be limited to three (3) minutes. In the event speaker(s) request additional time the determination of the amount of time to be allowed shall be at the discretion of the Mayor.

If any person wishes to be a Party-Intervenor, the person shall request the Mayor to intervene at least 7 days prior to the public hearing and include with the request: (a) a detailed outline of their interest in the application and argument in favor or against it; and (b) the amount of time required for the Party-intervenor’s presentation, and the justification for the time required. Notwithstanding, upon proper showing, the Mayor shall have the discretion, even without a prior request, to grant Party-Intervenor status at the public hearing.

If anyone is planning on presenting a PowerPoint (or other similar) presentation to the City Commission, the person is responsible for coordinating with the City Clerk in advance.  At least 48 hours is recommended.  Under no circumstances shall the City allow a presentation from any media source (including flash drive and disc) to be presented from a City computer without the City staff having a reasonable opportunity to virus check the presentation.

All persons are advised that if a person decides to appeal any decision made by the City Commission with respect to any matter considered at such meeting or hearing, he or she will need a record of the proceedings, and that, for such purpose, he or she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.

In accordance with the Americans with Disabilities Act, any person with a disability requiring reasonable accommodation in order to participate in this meeting should call the City Clerk at (813) 659-4200 at least 48 hours prior to the public hearing.

The proposed ordinance may be inspected by the public at the offices of the City Clerk at the Nettie Berry Draughon Municipal Building, 302 West Reynolds Street, Plant City, Florida.

This Business Impact Estimate is provided in accordance with section 166.041(4), Florida Statutes.  If one or more boxes are checked below, this means the City of Plant City (the "City") is of the view that a business impact estimate is not required by state law1 for the proposed ordinance, but the City is, nevertheless providing this Business Impact Estimate as a courtesy and to avoid any procedural issues that could impact the enactment of the proposed ordinance.  This Business Impact Estimate may be revised following its initial posting.

☐ The proposed ordinance is required for compliance with Federal or State law or regulation;

☐  The proposed ordinance relates to the issuance or refinancing of debt;

☐ The proposed ordinance relates to the adoption of budgets or budget amendments, including revenue sources necessary to fund the budget;

☐ The proposed ordinance is required to implement a contract or an agreement, including, but not limited to, any Federal, State, local, or private grant, or other financial assistance accepted by the municipal government.

☐  The proposed ordinance is an emergency ordinance;

☐  The ordinance relates to procurement; or

  The proposed ordinance is enacted to implement the following:

  a. Development orders and development permits, as those terms are defined in Section 163.3164, Florida Statutes and development agreements, as authorized by the Florida Local Government Development Act under Sections 163.3220-163.3243, Florida Statutes;

 b. Comprehensive plan amendments and land development regulation amendments initiated by an application by a private party other than the municipality;

  c. Section 190.005 and 190.046, Florida Statutes, regarding community development districts;

  d.   Section 553.73, Florida Statutes, relating to the Florida Building Code; or

  e.    Section 633.202, Florida Statutes, relating to the Florida Fire Prevention Code

In accordance with the provisions of controlling law, even notwithstanding the fact that, an exemption noted above may apply, the City hereby publishes the following information:

1. Summary of the proposed ordinance (must include statement of the public purpose, such as serving the public health, safety, morals, and welfare):

Ordinance 39-2024 would modify the existing Oakmont Landing Planned Development District to create the Urbon at Plant City Planned Development District. Serves the public purpose, by approving a private sector rezoning application, to allow for 267 multifamily housing units with access to James L. Redman Parkway (SR 39).

2. An estimate of the direct economic impact of the proposed ordinance on private, for-profit businesses in the City, if any:

(a) An estimate of direct compliance costs that businesses may reasonably incur;

(b) Any new charge or fee imposed by the proposed ordinance, or for which businesses will be financially responsible; and

(c) An estimate of the City’s regulatory costs, including estimated revenues from any new charges or fees to cover such costs.

There are currently no businesses located on the area proposed for development.

The aforementioned Urbon at Plant City Planned Development District imposes conditions on the development of the subject property that have been agreed upon by the developer/owner.  None of the conditions on the Planned Development Site Plan (floor area ratio, buffering, access, parking, water, sewer, stormwater, drainage, signage, etc.) exceed the requirements currently in place in the Plant City Code. Except for said conditions in the Planned Development Site Plan, the adoption of Ordinance 39-2024 does not impose any direct compliance costs on any businesses, nor does the Ordinance impose any new charge or fee for which businesses will be financially responsible.

The ordinance imposes no regulatory costs.

3. Good faith estimate of the number of businesses likely to be impacted by the proposed ordinance:

There are currently no businesses located on the area proposed for development.  The proposed project will be a residential multifamily (up to 276 units) community.
